DACA Eligibility Requirements

DACA has specific eligibility requirements that must all be met. We review your situation carefully before filing — including any criminal history that could affect your case.

Arrival Before Age 16

You must have entered the United States before your 16th birthday, regardless of how you entered or what visa (if any) you held at entry.

Continuous Presence Since June 15, 2007

You must have lived continuously in the U.S. since June 15, 2007. Brief, innocent trips abroad may be excused — we analyze your specific travel history.

Present on June 15, 2012

You must have been physically present in the U.S. on June 15, 2012 — the date DACA was announced — and at the time of your application.

Education or Military Service

Currently enrolled in school, have a high school diploma or GED, or have been honorably discharged from the U.S. armed forces.

No Disqualifying Criminal History

No felony convictions, no significant misdemeanors, and not more than three misdemeanors. We review your criminal history before filing to avoid surprises.

Not a Threat to Public Safety

You must not pose a threat to national security or public safety. Gang affiliation or immigration violations beyond unlawful presence may disqualify.

DACA & Other Temporary Protections

DACA and TPS work authorizations expire — and a lapse in status can have immediate consequences for your employment and any future immigration benefits. USCIS recommends filing renewals at least 150 to 180 days before your current period expires. We track every client's renewal deadline and remind you well in advance so you never have to worry about a gap in coverage.
