Which Waiver Do You Need?

Most immigration inadmissibility issues fall into one of these three categories. Each waiver has different eligibility rules, timelines, and required evidence. Getting them confused — or filing the wrong one — can reset the clock.

I-601A — Unlawful Presence Waiver

Filed before leaving the U.S. for a consular visa interview. Allows individuals who have accrued unlawful presence (triggering 3- or 10-year bars) to apply for a waiver from inside the U.S. — so they do not have to wait abroad for years.

Best for: Immediate relatives of U.S. citizens or LPRs who have overstayed or entered without inspection.

I-601 — General Inadmissibility Waiver

The broader waiver — covering health-related grounds, criminal history, fraud or misrepresentation, prior removal, and more. Filed abroad at the consulate after a visa denial, or in certain adjustment of status cases in the U.S.

Best for: Those denied a visa due to criminal history, misrepresentation, prior deportation bars, or prior unlawful presence without the I-601A option.

I-212 — Permission to Reapply After Removal

If you were deported or removed and have a mandatory bar to re-entering the U.S. (5 years, 10 years, 20 years, or permanent), an I-212 waiver seeks USCIS permission to apply for re-entry despite that bar.

Best for: Anyone who was previously deported, removed, or granted voluntary departure under a removal order, and now wishes to return legally.

What Makes a Waiver Succeed

Waivers are not automatically granted. The central question is whether the hardship to a qualifying U.S. citizen or LPR relative is "extreme" — a standard that requires real evidence, not just statements. These are the pillars of a strong waiver package.

After a Denial

Waiver Denied? You May Still Have Options.

A waiver denial is not necessarily the end of the road. Depending on which waiver was denied and why, you may be able to file a motion to reconsider, a motion to reopen, or an appeal to the Administrative Appeals Office (AAO). In some cases, federal court review under the Administrative Procedure Act is also available. The key is acting quickly — deadlines are strict.
