E-2 Dependent Visas & Employee Visas

The E-2 classification extends beyond the primary investor. Spouses and unmarried children under 21 of E-2 investors may obtain E-2 dependent status — and spouses are eligible for unrestricted employment authorization in the United States. Key employees of your E-2 business who share your treaty nationality may also qualify for E-2 status as essential employees.

  • Spouse receives E-2 dependent status
  • Spouse may apply for unrestricted work authorization (EAD)
  • Unmarried children under 21 receive E-2 dependent status
  • Children may attend school in the U.S.
  • Dependents do not need to share treaty country nationality
